LIMERICK PA – Limerick supervisors intend to vote on adopting an official township map following a public hearing on the matter scheduled for June 4 (2013; Tuesday) during their first meeting of the month at 7 p.m. in the township municipal building, 646 W Ridge Pike. The map indicates the layout of existing streets, and designates and reserves areas for future streets and other facilities.
A legal advertisement announcing the hearing was published Tuesday (May 7, 2013). The text of the notice follows:
NOTICE IS HEREBY GIVEN that on June 4, 2013 at 7:00 P.M. at the Limerick Township Municipal Building located at 646 West Ridge Pike, Limerick, Pennsylvania, the Board of Supervisors of Limerick Township shall hold a Public Hearing and immediately thereafter will hold a Public Meeting to consider adoption of the following Ordinance entitled AN ORDINANCE AMENDING AND ADOPTING THE OFFICIAL MAP FOR LIMERICK TOWNSHIP.
The Ordinance is summarized as follows:
Section One of the Ordinance establishes the Legislative Intent for that Ordinance and states that Article IV of the Pennsylvania Municipalities Planning Code (“MPC”) authorizes the Limerick Township Board of Supervisors to adopt an Official Road Map of Limerick Township designating and reserving areas for future streets, and other municipal facilities.
Section Two of the Ordinance states that the Board of Supervisors of Limerick Township hereby adopts the Official Map prepared by Pennoni Associates Inc. and Simone Collins, dated March 14, 2013 which amends the Limerick Township Official Map adopted by Ordinance No. 336 to add Limerick Township open space reservations and amending trail locations to coordinate with alignments pursuant to the 2013 Greenway Trail Master Plan within Limerick Township as the revised Official Map of Limerick Township.
Section Three of the Ordinance is entitled Recording of Official Map.
Section Four of the Ordinance is entitled Amendments to Official Map and states that any amendments to the Official Map shall be made in a manner consistent with Article IV of the MPC, as amended.
Section Five of the Ordinance is entitled Incorporation of Governing Law.
Section Six of the Ordinance is entitled Revisions and states that the Limerick Township Board of Supervisors does hereby reserve the right, from time to time, to adopt modifications of, supplements to, or amendments of its ordinance including this provision.
Section Seven of the Ordinance is entitled Severability.
Section Eight is Entitled Effective Date and states that this Ordinance shall become effective five (5) days after adoption.
Section Nine of the Ordinance is entitled Failure to Enforce Not a Waiver and states that the failure of Limerick Township to enforce any provision of this ordinance shall not constitute a waiver by Limerick Township of its rights of future enforcement hereunder.
